I should probably add here that I haven't done this myself and have no intention of doing so -- I was just trying to enumerate all the possibilities.  Perhaps I got a little carried away :)

I do however still believe that some of the GPL-only markers are misplaced, such as the aforementioned SPI bus thing.  But it's perfectly within the rights of the authors of that code to do that if they want, and nobody should be circumventing it.
